STANDARD TERMS AND CONDITIONS OF SALE

1. Acceptance of Terms: These Terms and Conditions (Terms) apply to all goods and services supplied by Emergency Ready Australia. They prevail over any inconsistent terms or conditions in any document or communication from the Client (including any purchase order). The Client's placement of an order for, or acceptance of, the supply of goods or services from Emergency Ready Australia constitutes acceptance of these Terms. No variation of these Terms is binding unless expressly agreed in writing by an authorised representative of Emergency Ready Australia. 
2. Payment Terms: Payment for all goods and services is required at the time of purchase. Orders will not be dispatched or services rendered until full payment has been received and confirmed. By placing an order, you agree to these payment terms. 
3. Shipping and Delivery: Delivery costs are calculated at checkout. All delivery times are estimates only and are not guaranteed. The risk of loss for all goods passes to you upon our delivery to the courier or postal service. It is your responsibility to provide a correct and complete delivery address.
4. Returns, Refunds and Consumer Guarantees: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. We are not required to provide a refund for 'change of mind' or for incorrect orders placed by the customer.
5. If you believe a product you have purchased from us is faulty or defective, you must contact us in writing as soon as the issue becomes apparent. Upon receiving a valid claim, we will provide a remedy in line with our obligations as the supplier under the ACL. This may include a repair, replacement, or refund, depending on whether the problem is considered a major or minor failure.
6. To the fullest extent permitted by law, Emergency Ready Australia is not liable for any indirect or consequential loss or damage, including loss of profit, revenue, or business opportunity.
7. Privacy: We are committed to protecting your privacy. Our collection, use, and disclosure of personal information are governed by the Australian Privacy Principles (APPs) set out in the Privacy Act 1988 (Cth). By using our website and services, you consent to the collection, use, and disclosure of your personal information in accordance with our Privacy Policy. 9. Governing Law: These Terms are governed by the laws of Queensland, Australia. Each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of Queensland.
